Can a person object to a Motion to Compel?
I received a Notice of Motion and Motion for Order Compelling Production of Documents. The affidavit is filled with a bunch of untruths. How do I combat this? Do I simply file an answer to each of her accusations, the way I would fine a normal answer? Can I do that?Can a person object to a Motion to Compel?Why wouldn't you respond the same way you respond to any other motion? You always have the right to object to any request for a motion by the other side. If you have a compelling argument against producing the requested documents, then you may present it to the judge and have it considered as part of the decision. The judge has the final say. If the judge grants the motion, you must produce the requested documents, however, or be held in contempt of court.sea doo
